Immigration to Romania for European Union / South East Europe citizens

1. CITIZENS OF THE MEMBER STATES OF THE EUROPEAN UNION (EU) AND EUROPEAN ECONOMIC AREA (EEA).

The entry of the EU/EEA citizens on the Romanian territory is permitted at all border crossing points which are open for people transit if you present a valid national identity document, passport or other document issued under the current Emergency Ordinance for the European Union citizens, without the entry stamp of the border police in any of these documents.

2. FAMILY MEMBERS WHO ARE NOT EU / EEA CITIZENS

Family members who are not EU / EEA citizens may enter in Romania through all border crossing points which are open for people transit if you present a passport and a valid visa, excepting the case where the obligation to obtain the visa is abolished by law.

The entry visa for family members who are not EU/ EEA citizens is granted, upon request, by Romanian diplomatic missions and consular offices, with prior approval of the National Visa Centre of the Ministry of Foreign Affairs, within 48 hours and without payment of consular fees.

To obtain the entry visa, family members who are not citizens of the EU/ EEA must present the following documents:

  1. application form;
  2. valid passport;
  3. passport or identity card of a EU / EEA citizen, original and copy. If EU/ EEA citizen is already on the Romanian territory, a copy of the passport or identity card as well as the copy of the document certifying the residence of the EU / EEA citizen on the territory of Romania, certified according to the original by the Romanian Immigration Office;
  4. if applicable, the following documents:
    1. marriage certificate or kinship documents with the EU / EEA citizen for family members;
    2. documents issued by authorities of the country of origin of the visa applicant that can prove that the person is a family member of the EU / EEA citizen, but does not fall within the definition of art. 2 par. (1) point 3 of OUG no.102/2005 with subsequent amendments and completions, is dependent upon him / her or cohabitates with the EU / EEA citizen or is in a situation where, for serious medical reasons, he needs the EU/ EEA citizen’s care;
    3. document attesting that the individual’s partnership with the EU / EEA citizen was registered in the EU / EEA state, if registered partnership, or documents certifying that the visa applicant has a long-standing relationship of cohabitation with the EU / EEA citizen, if not a registered partnership;

If the family member who is not a citizen of the European Union holds a valid document attesting residence in another Member State as a family member of an EU citizen, is exempt from the requirement to obtain an entry visa. The border police authorities do not apply the entry or exit stamp in the passport of persons in this category.

  • Establishing the object of activity
  • The choice of the object of activity is carried out in accordance with the classification of the new CAEN code. You can choose only one main object of activity and an unlimited number of secondary objects of activity.

Company name reservation

  • The reservation of the name of the firm will be made at the Register of Commerce.
  • Establishment of the registered office

The registered office is established by means of a use/lease contract, contract which is concluded between the landlord and the future company, based on the company name reservation from O.N.R.C. (National Trade Register Office). It is also needed a copy of the property act of the natural of legal person wishing to provide the building for the establishment of the company’s registered office. Still, neighbors and homeowners’ association must give you their consent. This is done in the form of a table, comprising apartment no, name and surname, identity card series and no. as well as their signature.

The Constitutive Act

For carrying trading activities and establishment of a limited liability company, a constitutive act is concluded. For this present act, it is advisable to call for specialists in the field.

The Constitutive Act must contain:

  • The main and secondary objects of activity
  • Company name (including the reservation number from O.N.R.C.)
  • The names of the associates and the contribution of each to the share capital
  • The name of the manager/administrator and the period for which will have this function

The manager and the associates will issue an affidavit, to the effect that they have no criminal record and that they meet the legal conditions for the possession of these qualities.

Deposit of the share capital at the bank

The capital shall be submitted in a special “social capital” account for which banks usually have special forms, and the bank employees should know to advise you about it.

The minimum share capital for LLC: 200 RON.

The specimen signature

The person who will be named Administrator in the company will personally move to a Public Notary to give the Specimen of Signature, which will be then submitted to the company establishment file.

Submission of documents and registration to the National Trade Register Office

When the file is complete, it is submitted to the Trade Register of the court in whose range the company’s registered office is.

The judge delegated by the Territorial Court verifies the lawfulness of the documents submitted and authorizes the registration of the company; the conclusion of the delegated judge is submitted for publication in the Official Gazette of Romania.

Papers pick up

The Trade Registry will issue the following documents that will certify the establishment of your company:

  • Company registration certificate
  • The decision of the Court by the National Trade Register Office
  • Confirmation of (registered) company details.

1. FOR EU / EEA CITIZENS

  5. fees.

2. FOR FAMILY MEMBER OF THE EU / EEA CITIZENS

  1. application form;
  2. valid identity card or passport (original and copy);
  3. registration certificate (original and copy);
  4. papers and documents that prove the conditions provided by law on the legality and continuity of residence to obtain the right of permanent residence;
  5. fees.

THE SINGLE PERMIT / EU BLUE CARD

To obtain a single permit or a EU Blue Card, you will personally submit several documents at least 30 days before the expiry of the right to stay granted by the visa.

For the first extension of the right of residence (getting the first single permit or the EU Blue Card) for employment you must submit the following documents:

  • application form,
  • the border crossing document (passport/ travel document),
  • proof of legal ownership of the living,
  • individual employment contract and print screen from the register of the employees, at the section containing the data about the individual employment contract signed by the employer
  • medical certificate
  • taxes

Other categories of foreigners who may prolong the right of residence for work purposes

DEPLOYED FOREIGNERS:

  • application form and taxes,
  • border crossing document (original and copy),
  • the decision of deployment translated and legalized,
  • proof of legal ownership of the living space (original and duplicate)
  • proof of financial means of support amounting to at least the average gross wage per economy,
  • proof of social health insurance,
  • medical certificate;

HEADS OF REPRESENTATIVE OFFICES

  • application form and taxes,
  • operating license
  • proof of legal relations between the applicant and the representative office
  • proof of legal possession of the space for the headquarters
  • proof of financial means of support
  • medical certificate;
  • proof of legal ownership of living space
  • proof of social health insurance

HEADS OF BUSINESS UNIT / BRANCH

  • application form and fees,
  • certificate issued by the Trade Registry,
  • evidence of legal relations between the applicant and representative office,
  • proof of legal possession of the space for headquarters,
  • medical certificate,
  • proof of means of support,
  • proof of legal ownership of the living space,
  • social health insurance.

The request for the granting of the extension of the right of residence for employment / deployment will be settled within 30 days from the date of its submission. In case further checks are required, the deadline for resolving the application may be extended by no more than 15 days.

The request for extension of the right to stay, filed by the holder of a EU Blue Card obtained in another EU Member State shall be settled within 15 days since reception.
